Terms of Service

1. Services Description

FansLeakRemoval provides content removal services including DMCA takedown submissions, search engine delisting requests, and monitoring for re-uploads. Our services are provided on a best-effort basis. We do not guarantee removal of any specific content, as outcomes depend on platform policies, jurisdictional factors, and circumstances outside our control.

2. Service Scope and "Unlimited" Takedowns

Plans described as including "unlimited takedowns" or "comprehensive removal" are subject to the following scope limitations:

  • Covered Platforms: Unlimited takedowns apply to mainstream platforms including major social media (Reddit, Twitter/X, Instagram, Facebook, TikTok), major adult tube sites (Pornhub, xVideos, xHamster, and similar), file hosting services (Google Drive, Mega, Dropbox), forums with DMCA compliance, and search engines (Google, Bing).
  • Reasonable Volume: "Unlimited" is intended for legitimate leak situations. We reserve the right to require a custom quote for cases involving more than 200 unique URLs or requiring action on more than 30 distinct platforms.
  • Service Period: Active takedown work is performed for 30 days from purchase for one-time packages. Cases requiring work beyond 30 days may require an additional package or subscription.

3. Platform Limitations

Certain platforms present unique challenges and are handled on a best-effort basis only:

  • Telegram: Telegram is headquartered outside US jurisdiction and historically has low DMCA compliance rates. We will attempt removal but cannot guarantee results. Telegram channels and bots may require ongoing monitoring.
  • Offshore/Non-Compliant Hosts: Websites hosted in jurisdictions that do not honor DMCA requests (including but not limited to certain Eastern European, Asian, and offshore hosting providers) may not respond to takedown requests.
  • Encrypted/Private Platforms: Content shared in encrypted channels, private groups, or direct messages may be impossible to detect or remove.
  • Decentralized Services: Content on blockchain-based platforms, IPFS, or similar decentralized networks cannot be removed through traditional takedown methods.

We will inform you if your content appears on platforms with known compliance issues and discuss available options, but removal from such platforms is not guaranteed under any service tier.

4. Re-Upload Monitoring Limitations

Monitoring periods included with packages (e.g., "30-day monitoring," "90-day monitoring") cover:

  • Automated scanning of major platforms for re-uploads of previously identified content
  • Filing of new takedown requests for detected re-uploads on covered platforms
  • Monthly summary reports (for subscriptions)

Monitoring does NOT include: 24/7 human surveillance, guaranteed detection of all re-uploads, monitoring of private/encrypted channels, or removal from non-compliant platforms. Persistent re-uploaders may require ongoing subscription service for continued protection.

5. Eligibility and Age Requirement

You must be at least 18 years of age to use our services. By using our services, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

6. Client Representations and Warranties

By using our services, you represent and warrant that:

  • You are the rightful copyright owner of the content you request us to remove, OR you are legally authorized to act on behalf of the copyright owner
  • All information you provide is accurate and truthful
  • You will provide documentation to support your ownership claims upon request
  • You understand that filing false DMCA claims may result in legal liability
  • The content you request removal of was shared without your consent

7. Authorization as DMCA Agent

By engaging our services, you authorize FansLeakRemoval to act as your designated agent for the purpose of filing DMCA takedown notices and other content removal requests on your behalf. This authorization remains in effect for the duration of your service agreement.

8. No Guarantee of Results

WE MAKE NO GUARANTEES REGARDING THE SUCCESS OF ANY TAKEDOWN REQUEST. Results depend entirely on third-party platform policies, legal jurisdictions, the specific nature of each case, and other factors outside our control. We cannot guarantee:

  • That any specific content will be removed
  • Any particular timeline for removal
  • That removed content will not reappear
  • That all instances of your content will be found or removed

9. Payment Terms

One-time packages are charged upon engagement. Monthly subscriptions are billed in advance on a recurring basis. All fees are non-refundable except as expressly stated in our Refund Policy below.

10. Refund Policy

One-Time Packages: If we file takedown requests and the target platforms do not remove any content within 60 days despite our efforts, you may request a partial refund of up to 50% of the service fee. Refund requests must be submitted in writing within 90 days of purchase.

Monthly Subscriptions: You may cancel at any time. Cancellation takes effect at the end of your current billing period. No refunds are provided for partial months.

Refunds are NOT available if: (a) content was removed but later reappeared, (b) you provided inaccurate information, (c) you cannot prove copyright ownership, (d) removal failed due to platform non-compliance (e.g., Telegram, offshore hosts), or (e) the case exceeded reasonable scope limits requiring a custom quote.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FANSLEAKREMOVAL'S TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR OUR SERVICES SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, REPUTATION, OR BUSINESS OPPORTUNITIES.

12. Not Legal Advice

FansLeakRemoval is NOT a law firm and does NOT provide legal advice. Our services are limited to administrative filing of takedown requests. For legal matters including but not limited to pursuing litigation, understanding your legal rights, or responding to legal threats, you should consult with a qualified attorney licensed in your jurisdiction.

13. Counter-Notifications

If a party files a counter-notification disputing your DMCA claim, we will notify you. The decision to pursue further legal action is yours alone. We do not provide legal representation and cannot advise you on how to proceed with disputes.

14. Indemnification

You agree to indemnify and hold harmless FansLeakRemoval, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from: (a) your use of our services, (b) your violation of these Terms, (c) your violation of any third-party rights, or (d) any false or misleading information you provide.

15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes arising from these Terms or our services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

16. Modifications

We reserve the right to modify these Terms at any time. We will notify active clients of material changes via email. Continued use of our services after changes take effect constitutes acceptance of the modified Terms.

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
